Abuso edilizio - sanatoria - inapplicabilità dell'art. 107, comma 23 L.P. n. 13/1997

Il principio dell'applicazione rigorosa delle norme urbanistiche, a cui si ispira il legislatore provinciale, inibisce un'interpretazione estensiva o addirittura analogica delle norme che regolano la sanatoria di abusi edilizi e non permette la configurabilità di ipotesi di „sanatoria  non specificamente previste dalla legge, per cui non appare ammissibile avvalersi, a scopi sanatori di abusi edilizi, al di fuori delle specifiche fattispecie previste agli art. 85 e 88 della L.P. 11 agosto 1997 n. 13, di una norma eccezionale quale quella dell'art. 107, comma 23, che, nell'intento di agevolare la costruzione di abitazioni agevolate, permette il trasferimento di cubatura in luogo diverso, per esplicitate e comprovate ragioni di idoneità urbanistica, ambientale o paesaggistica.
