Commercio - autorizzazione amministrativa - attività abusiva - ordinanza di chiusura

L'art. 8, co. 4 DPGP 30 ottobre 2000 n. 39 non riguarda la cessione di un ramo di azienda, che comporta anche il trasferimento della titolarità dell'autorizzazione ai terzi (c.d. subingresso), ma regola l'ipotesi di affidamento a terzi di uno o più reparti, con permanenza della titolarità dell'autorizzazione al dominus.
 
L'art. 23, co. 3 L.P. 17 febbraio 2000 n. 7, sia sotto il profilo letterale, sia sotto quello logico, è da interpretarsi nel senso che, in caso di svolgimento abusivo dell'attività di commercio, va ordinata la chiusura totale dell'esercizio di vendita, mentre in caso di ampliamento non autorizzato va disposta la chiusura parziale.
