Risarcimento del danno per azione amministrativa - Giudice amministrativo - decorrenza del termine - illegittimo ritardo nel pagamento di contributo in denaro: è produttivo di danni interessi

L'art. 7 L. 21 luglio 2000 n. 205 (sostitutivo dell'art. 35 co. 4 D.Lgs. 31 marzo 1998 n. 80) ha esteso la cognizione del Giudice amministrativo, nell'ambito generale di legittimità, anche a tutte le questioni relative al risarcimento del danno ingiusto. E' quindi infondata la tesi che tali questioni siano devolute al Giudice amministrativo solo nell'ambito della sua giurisdizione esclusiva.
 
Il dies a quo del termine di prescrizione del diritto al risarcimento del danno va individuato nella data di annullamento definitivo del provvedimento illegittimo, considerato che solo a partire da tale data può essere azionato il diritto medesimo.
 
Il danno ingiusto conseguente a provvedimento amministrativo illegittimo è risarcibile solo in presenza di tutti i requisiti previsti dall'art. 2043 c.c., che resta tuttora, anche davanti al Giudice amministrativo, la norma fondamentale in tema di risarcibilità del danno: oltre alla sussistenza del danno ingiusto (e cioè alla lesione della situazione soggettiva di interesse tutelato dall'ordinamento) è indispensabile che sussista la colpa (o il dolo) della P.A., che sia accertata l'esistenza di un danno patrimoniale, ed infine che sussista il nesso causale tra l'illecito ed il danno subito.
 
Per il principio della naturale fecondità del danaro, l'illegittimo ritardato pagamento di un contributo provinciale (nella specie, per l'acquisto di terreni in zona produttiva) produce interessi (cosiddetti danni interessi), che spettano a titolo di risarcimento anche a prescindere dalla concreta prova di un danno (artt. 1282 e 1224 c.c.).
