Widerruf von Beiträgen für Industrie und Gewerbe - Berufung auf allgemeine Gründe des öffentlichen Interesses und auf allgemeine Verwaltungspraxis ungenügend

Urteil vom 21 April 2005, Nr. 177; Präs. Demattio, Verf. Zelger
Der öffentlichen Verwaltung steht es nicht zu  Maßnahmen, mit welchen die Reduzierung von Beiträgen beschlossen werden, zu erlassen, wenn dabei einzig  Begründungen angeführt werden, welche sich ausschließlich auf Normen berufen, die erst nach der Beitragsgewährung verabschiedet worden sind. Ebenso reicht ein allgemeiner Hinweis im Beschluss, dass die Beitragsgewährung im Gegensatz zum öffentlichen Interesse sowie zu den Zielen des L.G. vom 8.September 1981 Nr. 25 stehen würde, nicht aus, einen Widerruf eines bereits gewährten Zuschusses zu beschließen, wenn dort erklärt worden ist, dass das Vorhaben, für welches um einen Beitrag angesucht worden ist, den Kriterien zur Anwendung der Richtlinien gemäß Art. 2 des obgenannten Gesetzes entspricht.
