Giustizia amministrativa - nozione di controinteressato - tutela delle minoranze: legittimazione ad agire contro atti lesivi - conoscenza delle lingue italiana e tedesca - pubblici concorsi

Nel processo amministrativo i controinteressati in senso tecnico devono essere nominativamente indicati nel provvedimento impugnato o agevolmente individuabili in base ad esso; e pertanto, nell'impugnativa di un bando di concorso, non sono ipotizzabili controinteressati.
 
Per il disposto degli artt. 32/ter e 43 DPR 26 luglio 1976 n. 752 sussiste in capo allo Stato o alla Provincia autonoma di Bolzano la legittimazione ad agire in giudizio avverso atti lesivi delle prescrizioni contenute nello stesso decreto, e ciò indipendentemente dal verificarsi di eventuali casi concreti.
 
La conoscenza della lingua italiana e di quella tedesca, quale requisito per le assunzioni ad impieghi nelle Amministrazioni dello Stato (comprese quelle con ordinamento autonomo) e degli enti pubblici in Provincia di Bolzano, ai sensi dell'art. 1 co. 1° DPR 26 luglio 1976 n. 752, deve essere posseduta dagli interessati – e comprovata a mezzo dell'apposito attestato – al momento della scadenza del termine di presentazione delle domande di partecipazione ai concorsi per dette assunzioni. Inoltre, ai sensi dell'art. 32/quater del DPR n. 752/1976, nel testo inserito con il D.Lgs. n. 272 del 23 maggio 2001, tale principio deve essere applicato anche dalle Agenzie “comunque denominate e strutturate” (nella specie, dall'Agenzia delle Entrate), e ciò in particolar modo nei casi in cui l'assunzione avviene per concorso.
