Le questioni riguardanti l'inquadramento e la qualifica dei pubblici dipendenti attengono ad interessi legittimi, e non a diritti soggettivi, considerato il carattere autoritativo dei relativi provvedimenti con i quali l'Amministrazione definisce il loro status giuridico ed economico nell'ambito del proprio apparato organizzativo; con la conseguenza che la tutela giurisdizionale è limitata ad un' azione di annullamento degli atti illegittimi, mentre rimane preclusa ogni azione di accertamento e di condanna.
 
Come previsto dall'art. 2 co. 3 L.P. 10 agosto 1995 n. 16, l'esercizio temporaneo di mansioni da parte di un dipendente pubblico (nella specie di un medico ospedaliero) non attribuisce al medesimo, in deroga all'art. 2103 c.c., il diritto all'assegnazione definitiva delle mansioni stesse.
