Festlegung der Warenbereiche Lebensmittel und Nichtlebensmittel gemäß Artikel 2 des Landesgesetzes vom 17. Februar 2000, Nr. 7 "Neue Handelsordnung"

Es werden die Bereiche Lebensmittel und Nichtlebensmittel wie folgt festgesetzt:
Lebensmittelwarenbereich: beinhaltet Lebensmittelprodukte jeder Art, frisch, gefroren, tiefgefroren oder jedenfalls konserviert, gekocht oder sonst wie für die Mitnahme zubereitete Speisen. Unter diesen Bereich fallen auch alle Arten von Nahrungsmitteln für Haustiere;
Nichtlebensmittelwarenbereich: beinhaltet alle Nichtlebensmittelprodukte für die Person, für den Haushalt und jeder Art. Unter diesen Bereich fallen auch lebendes Kleinvieh und Haustiere.
 
Mit weiterem Beschluss der Landesregierung werden die Spezialtabellen für Tankstellen, für Monopolwarenhandlungen, für Apotheken, für Schank- und Speisebetriebe, für Beherbergungsbetriebe, für Einzelhandelsgeschäfte in Campinganlagen, für Einzelhandel von in Flaschen abgefüllten Getränken, für den Verkauf in Kinosälen, Theatern, Schwimmbädern, Gärtnereien und für die Einzelhandelsbetriebe in Gewerbezonen festgelegt.
Die Erlaubnisse zur Eröffnung, Übersiedlung und Vergrößerung eines Einzelhandelsbetriebes, erteilt im Sinne des Artikels 26, Absatz 2, des Landesgesetzes vom 17. Februar 2000, Nr. 7 für den Nicht-Lebensmittelbereich, mit Ausnahme der Bekleidung, ermächtigen auch weiterhin nicht zum Verkauf der obgenannten Artikel. Die Gesuche zur Erweiterung der Erlaubnisse auch auf die Bekleidungsartikel können erst nach dem Termin für die Genehmigung der Gemeinde- und Landesplanungsinstrumente eingereicht werden.
 
Allgemeine Bestimmungen:
1. In Zweifelsfällen über den Wareninhalt der Warenbereiche sowie der Sondertabellen entscheidet der zuständige Landesrat;
2. Das Verbot hingegen, auf öffentlichem Grund alkoholische Getränke beliebiger Art zu verkaufen, die nicht laut Artikel 176, Absatz l der Durchführungsverordnung zum vereinheitlichten Text der Gesetzes für öffentliche Sicherheit, in verschlossenen Behältern feilgeboten werden, sowie das Verbot Waffen, Sprengstoff und Wertgegenstände zu verkaufen oder feilzubieten bleibt aufrecht.
3. Was die Vermarktung betrifft, bleiben die Hygienevorschriften, die Bestimmungen über die öffentliche Sicherheit und die von Sondergesetzen geregelten Vorschriften aufrecht.
 
Dieser Beschluss wird im Amtsblatt der Region kundgemacht.
