Widerruf von Wohnbauförderungen im Falle einer Veräußerung - Schenkung zwischen Vater und Sohn

Gemäß Art. 3, Abs. 2, Buchstabe c) des L.G. vom 2. April 1962, Nr. 4 hat die Veräußerung oder Vermietung der geförderten Wohnung den Widerruf der Förderung zur Folge. Dies auch im Falle einer Schenkung zwischen Vater und Sohn, da unter dem Begriff der Veräußerung jede durch Übertragung eines Rechts vorgenommene rechtsgeschäftliche Verfügung zu verstehen ist, wonach also auch die Schenkung, die ja ein Vertrag ist, unter diesen Begriff fällt. Das Veräußerungsverbot ohne Ermächtigung hat nicht nur den Zweck, Spekulationen zu verhindern - was bei einer Schenkung innerhalb der Familie auch ausgeschlossen werden kann - sondern auf jeden Fall zu garantieren, daß die Wohnung nur förderungswürdigen Personen zugute kommt.
