L'impugnazione di un atto conseguenziale e successivo non fa venir meno l'interesse al ricorso già proposto avverso l'atto presupposto, in quanto gli atti successivi vengono travolti dall'eventuale annullamento giurisdizionale di quello presupposto. Così, l'impugnazione del bando di concorso, quale atto presupposto, non fa sorgere nel ricorrente l'onere di impugnare anche le successive graduatorie e nomine dei vincitori, poiché questi atti, strettamente consequenziali, vengono travolti per effetto dell'annullamento giurisdizionale dell'atto gravato.
 
Il D.P.G.P. 1° giugno 1995 n. 26 - recante il regolamento sulla individuazione dei profili professionali e la loro ascrizione alle qualifiche funzionali per il personale della Provincia autonoma di Bolzano – stabilisce tra l'altro i rispettivi requisiti di accesso. Con l'art. 9 di detto regolamento (che richiama una previsione già contenuta nell'art. 4 del D.P.G.P. 2 giugno 1992 n. 21) è peraltro consentito che per i profili professionali con più requisiti di accesso ascrivibili a diverse aree professionali, i relativi requisiti possano essere limitati nei singoli bandi, per motivate e particolari esigenze di servizio. Data la rigorosa previsione di tale norma, l'Amministrazione deve quindi adempiere all'obbligo motivazionale fornendo accurati elementi circa le ragioni e l'iter logico seguito per giungere alla limitazione ritenuta opportuna.
