L'atto amministrativo di assegnazione di aree nelle zone produttive va qualificato come atto di concessione traslativa di un bene pubblico vincolato all'attività produttiva; con la conseguenza che l'eventuale controversia rientra nella giurisdizione esclusiva del giudice amministrativo, ai sensi dell'art. 5 della L. 6 dicembre 1971 n. 1034 e s.m..
In caso di revoca di un atto amministrativo legittimo, per rinnovata valutazione del pubblico interesse, che intervenga su un atto “ad efficacia durevole”, e che produca effetti sfavorevoli a carico del soggetto interessato, pregiudicandone i diritti soggettivi acquisiti attraverso l'atto da revocare, l'amministrazione deve disporre un indennizzo, come previsto dall'art. 21 quinquies della L. 7 agosto 1990 n. 241 (aggiunto dall'art. 14 L. 11 febbraio 2005 n. 15).
Il procedimento concessorio di terreno in zona produttiva deve ritenersi concluso con la deliberazione di assegnazione definitiva, mentre le vicende successive alla deliberazione (ad es. emissione della nota di addebito, pagamento del corrispettivo, consegna materiale del terreno, intavolazione del diritto di proprietà, ecc.) esulano dal procedimento amministrativo già perfezionato e sono relative all'esecuzione del rapporto negoziale accessivo.
Ai fini del risarcimento del danno è richiesta la positiva verifica, da parte del giudice, di tutti i requisiti previsti e precisamente: la lesione della situazione soggettiva tutelata, l'esistenza di un danno ingiusto, la sussistenza di un nesso causale tra l'illecito ed il danno subito e la responsabilità dell'amministrazione.
