Edilizia abitativa agevolata - notifica del ricorso giurisdizionale all'organo interno che ha emesso l'atto impugnato - revoca agevolazioni - contraddittorio con interessato e appropriata istruttoria

Sentenza del 29 giugno 2007, n. 249, Pres. Rossi Dordi, Est. Del Gaudio
Se la notifica del ricorso avverso la delibera della commissione provinciale di vigilanza sull'edilizia abitativa agevolata, comminatoria di una sanzione, viene effettuata presso l'organo interno della Provincia che ha emanato il provvedimento impugnato, l'organo stesso è legittimato a riceverla, avendo però l'onere di informarne l'ente, atteso che il medesimo difetta di legittimazione passiva a rappresentare in giudizio la Provincia.
Pur in presenza di risultanze anagrafiche e di consumi di acqua dell'utenza, quali utili elementi di valutazione per la verifica dell'esatta osservanza, da parte del beneficiario, dei contributi edilizi agevolati, delle disposizioni che ne disciplinano la concessione, l'amministrazione è comunque tenuta, una volta avviato il procedimento amministrativo finalizzato alla revoca del beneficio, ad agire in contraddittorio con l'interessato e a verificare, con appropriata istruttoria, le osservazioni dal medesimo presentate.
