Agenzia di viaggi e turismo - autorizzazione all'apertura - competenza provinciale - elenco nazionale delle agenzie

Sentenza del 10 novembre 2005, n. 376; Pres. Mosna, Est. Del Gaudio
La competenza al rilascio dell'autorizzazione all'apertura di agenzie di viaggi e turismo spetta alla Provincia autonoma di Bolzano ai sensi dell'art. 1 del D.P.R. 22 marzo 1974 n. 278. Essa, tra l'altro, al fine di evitare possibili confusioni tra denominazioni delle agenzie di viaggio nell'interesse sia delle medesime che degli utenti, deve valutare, con discrezionalità tecnica, la correttezza della denominazione delle agenzie per le quali viene richiesta la licenza. Al riguardo, poiché l'art. 9 della L. 17 maggio 1983 n. 217 pone a carico dello Stato l'incombenza di tenere ed aggiornare un apposito elenco nazionale delle agenzie di viaggio, l'amministrazione provinciale è tenuta a consultare il competente Ministero dell'Industria Commercio e Artigianato al fine di evitare di incorrere in duplicazioni o assonanze di denominazioni.
