Kundgemacht im G.Bl. vom 27. Dezember 1947, Nr. 298 - Sondernummer; die Verfassung wurde von der Verfassungsgebenden Versammlung am 22. Dezember 1947 genehmigt, vom provisorischen Staatsoberhaupt am 27. Dezember 1947 verkündet und ist seit dem 1. Jänner 1948 in Kraft.

Art. 10

(1) Die italienische Rechtsordnung paßt sich den allgemein anerkannten Bestimmungen des Völkerrechts an.

(2) Die Rechtsstellung des Ausländers wird in Übereinstimmung mit den völkerrechtlichen Bestimmungen und Verträgen gesetzlich geregelt.

(3) Der Ausländer, der in seinem Lande an der tatsächlichen Ausübung der von der italienischen Verfassung gewährleisteten demokratischen Freiheiten behindert ist, genießt gemäß den gesetzlich vorgesehenen Bedingungen das Asylrecht im Gebiet der Republik.

(4) Die Auslieferung der Ausländer wegen politischer Verbrechen ist unzulässig.
