Conflitto di attribuzione non notificato al Presidente del Consiglio dei Ministri

Ritenuto che con ricorso notificato il 14 maggio 1986 al Ministro dell'industria, del commercio e dell'artigianato, al Ministro del Tesoro e al Ministro del lavoro e della previdenza sociale, la Regione Trentino-Alto Adige ha sollevato conflitto di attribuzione, impugnando il decreto del Ministro dell'industria, commercio e artigianato 8 novembre 1985 (pubblicato sulla G.U. del 17 marzo 1986, n. 63), avente ad oggetto «Procedura di attuazione dell'art. 7 della L. 27 febbraio 1985, n. 49, concernente provvedimenti per il credito alla cooperazione e misure urgenti a salvaguardia dei livelli di occupazione»;
che nel ricorso si premette che la Regione ha impugnato anche la L. 27 febbraio 1985, n. 49 e si lamenta l'invasione di competenze ad essa garantite dallo Statuto speciale d'autonomia, chiedendosi, previa sospensione, l'annullamento del decreto impugnato;che dinanzi a questa Corte si è costituito il Presidente del Consiglio dei Ministri, eccependo l'inammissibilità del ricorso perché ad esso medesimo «non rivolto né notificato»;
 
Rilevato che effettivamente il ricorso non risulta notificato al Presidente del Consiglio dei Ministri;
Considerato che, a norma dell'art. 39 della L. 11 marzo 1953, n. 87 e dell'art. 27 delle norme integrative 16 marzo 1956, i conflitti di attribuzione tra Stato e Regioni debbono svolgersi esclusivamente in contraddittorio tra il Presidente del Consiglio dei Ministri e il Presidente della Regione interessata, qualunque sia l'autorità dello stato o della Regione che abbia emanato l'atto impugnato;
che, secondo la giurisprudenza di questa Corte (sent. 16 giugno 1983, n. 172), la mancata notificazione del ricorso della Regione al Presidente del Consiglio dei Ministri lo rende inammissibile;
Visti gli artt. 41 e 26 della L. 11 marzo 1953, n. 87;

Per questi motivi

LA CORTE COSTITUZIONALE

dichiara manifestamente inammissibile il conflitto di attribuzione promosso dalla Regione Trentino-Alto Adige con il ricorso indicato in epigrafe.
