Modifica criteri di valutazione in corso di gara - illegittimità

Illegittimamente, in sede di procedimento per l'aggiudicazione di pubblico appalto per forniture di arredi, la commissione di valutazione tecnica, dopo l'apertura delle buste delle offerte, modifica un criterio di valutazione introducendo una clausola più restrittiva rispetto al corrispondente criterio contenuto nel bando e nel capitolato: si configurano, in tal caso, violazioni delle leggi 8.8.1977 n. 584 e 30.3.1981 n. 113, le quali, innovando l'ordinamento giuridico a vantaggio della trasparenza e della obiettività nella valutazione discrezionale dell'Amministrazione, hanno introdotto il principio secondo i quale i criteri di valutazione da assumere nella gara ai fini della individuazione dell'offerta economicamente più vantaggiosa debbono essere già predeterminati nel bando di gara o nella lettera di invito; nonché violazione dell'art. 16 lettera b) del D.Lgs 24.7.1992 n. 358 che sancisce l'obbligo, per gli appalti in regime comunitario, della menzione nel bando e nel capitolato oneri dei criteri selettivi.
