Beschluss Nr. 1945 vom 29.11.2010
Artikel 22-ter des Landesgesetzes 17. Dezember 1998, Nr. 13, i.g.F. - Festsetzung der Kriterien bezüglich des Preises der Wohnungen

Folgendes wird vorausgeschickt:
1. Durch Landesgesetz Nr. 1 vom 22. Jänner 2010 ist nach Artikel 22-bis des Landesgesetzes Nr. 13 vom 17. Dezember 1998 (Wohnbauförderungsgesetzes) der neue Artikel 22-ter (Beschleunigung der Bauprogramme) eingefügt worden.
2. Durch Artikel 22-ter wird eine Bestimmung eingefügt, die in Abweichung von Artikel 19 des Raumordnungsgesetzes ( L.G. Nr. 13/1997) die Errichtung bzw. die Anschaffung von Wohnungen, die von den Bauprogrammen vorgesehen sind, beschleunigen soll.
3. Nach Maßgabe von Artikel 22-ter Absatz 1 Buchst. a) des besagten L.G. Nr. 13/1998 i.g.F., darf die Errichtung bzw. die Anschaffung der im vorigen Punkt erwähnten Wohnungen auch Gegenstand eines Wettbewerbes sein.
4. Der Preis der Wohnungen wird laut Artikel 22-ter Absatz 3 des L.G. Nr. 13/1998 i.g.F. nach folgenden Kriterien berechnet:

a)  der Konventionalwert pro Quadratmeter laut Artikel 7 Absatz 3 des L.G. Nr. 13/1998 i.g.F.  wird bis zu 25% erhöht bei Klimahausstandard B, der von der Agentur Klimahaus Bozen erlassen wird,

b)  der Konventionalwert pro Quadratmeter laut dem oben angeführten Buchstaben a) wird um 5% des Konventionalwertes pro Quadratmeter laut Artikel 7 Absatz 3 des L.G. Nr. 13/1998 i.g.F. erhöht bei Klimahausstandard A, der von der Agentur Klimahaus Bozen erlassen wird.

5. Der Preis gemäß Punkt 4 beinhaltet gegebenenfalls auch die Berichtigungskoeffizienten für den Erhaltungs- und Instandhaltungszustand.
6. Das Schätzamt des Landes begutachtet die Angemessenheit des Preises.
Dies vorausgeschickt und gestützt auf Artikel 22-ter Absatz 3 des Landesgesetzes vom vom 17. Dezember 1998, Nr. 13 i.g.F., Wohnbauförderungsgesetz,

die LANDESREGIERUNG

mit Stimmeneinhelligkeit und in gesetzlicher Form:
Der Preis der Wohnungen, laut Artikel 22-ter Absatz 3 des Landesgesetzes vom 17. Dezember 1998, Nr. 13 i.g.F. (Wohnbauförderungsgesetz) wird wie in der Prämisse bestimmt.
