Nelle gare pubbliche d'appalto, ai fini del rispetto della par condicio tra gli interessati alle forniture, le offerte, o parte di esse, non possono più essere modificate dopo la scadenza del termine utile per la consegna delle stesse alla stazione appaltante, dovendo essere fatte oggetto di valutazione solo le offerte presentate in sede di gara. Non rileva, pertanto, il fatto che nelle aziende produttrici di autoveicoli( o comunque di prodotti altamente sofisticati) i cambiamenti e le modifiche tecniche sono assai frequenti e di regola non prevedibili.
L'annullamento di una gara non determina la caducazione automatica del contratto d'appalto; peraltro, a seguito dell'annullamento, con effetto ex tunc, dei provvedimenti di gara viene comunque a mancare, sempre ex tunc, un requisito essenziale del contratto, cioè la dichiarazione di volontà della pubblica amministrazione; ciò secondo l'insegnamento della Corte di Cassazione in S.U. (n. 27169/2007), che si è così espressa: “Spetta al giudice ordinario la giurisdizione sulla domanda volta ad ottenere tanto la dichiarazione di nullità quanto quella di inefficacia o l'annullamento del contratto di appalto, a seguito dell'annullamento della delibera di scelta dell'altro contraente, adottata all'esito di una procedura ad evidenza pubblica”. Ne consegue che la stazione appaltante dovrà farsi parte diligente per l'adozione dei provvedimenti necessari a seguito dell'annullamento in toto delle operazioni di valutazione delle offerte.
