Klagebefugnis und Passivlegitimation der öffentlichen Körperschaft - Sachen von geschichtlichem und künstlerischem Wert - Verpflichtung zur Erhaltung - Zahlung einer Geldsumme für nicht wiederherstellbare Schäden

Gemäß Art. 75, Abs. 3 der Zivilprozessordnung steht die Aktiv- und Passivlegitimation einer öffentlichen Körperschaft dem gesetzlichen oder satzungsmäßigen Vertreter zu, der die Körperschaft nach außen hin vertritt und nicht den einzelnen Organen, die – sofern nicht ausdrücklich vom Gesetz vorgesehen – keine Rechtspersönlichkeit haben.
Auch für Vorfälle, welche  sich vor Inkrafttreten des Art. 5 – quater des L.G. Nr. 26 / 1975 (eingefügt im Jahre 2001) ereignet haben, gilt die Pflicht der Wiederherstellung des ursprünglichen Zustandes bzw. die Vergütung des Wertes der zerstörten, denkmalschutzgebundene Sache ( im Anlassfall handelte es sich um vier historische Kachelöfen in einem denkmalgeschützten Haus) und zwar aufgrund des staatlichen Denkmalschutzgesetzes Nr. 1089/1939, welches, ausgehend von der Pflicht zur Erhaltung der denkmalgeschützten Kulturgüter, ausdrücklich die Wiederherstellungspfllicht bzw. den Wertersatz durch die Zahlung einer Geldsumme vorsieht.
