Urbanistische Zweckbestimmungen - Dienstwohnung - Bestandteil der Zweckbestimmungskategorie des Gebäudes- Landschaftsschutzkommissionen - Gutachten - Überprüfung auch gemäß Urbanistiknormen

Urteil vom 22. November 2005, Nr. 402; Präs. Demattio, Verf. Zelger
Dienstwohnungen sind im Sinne des Art. 75 des L.G. Nr. 13 vom 11. August 1997, Nr.. 13 nicht als eigenständige Wohngebäude im Sinne des Buchstaben a) des Absatzes 2 einzustufen, sondern sie sind - im urbanistischen Sinne - Bestandteil der Zweckbestimmungskategorie, welcher das Gebäude zugeordnet ist. Der Art. 107, Abs. 13 des genannten L.G. Nr. 13/1997 lässt einen Erhalt bzw. die Verlegung der Dienstwohnung als eigenständiges Wohnvolumen nicht zu.
Die Landschaftsschutzkommission bzw. das Kollegium für Landschaftsschutz haben gemäß Art. 8, Abs. 3 des L.G. Nr. 16 vom 25. Juli 1970 die Möglichkeit, auch die urbanistischen Voraussetzungen zu prüfen und die Ablehnung der Anträge auch aus diesen Gründen vorzuschlagen. Der angeführte Art. 8, Absatz 3 besagt Folgendes : „Falls angenommen werden kann, dass das Gesuch des Bauwerbers mit den vorgeschriebenen Unterlagen nicht den urbanistischen Vorschriften entspricht, stellt der zuständige Direktor der Landesabteilung Natur und Landschaft den Akt an den Bürgermeister der interessierten Gemeinde zurück“.
