Verordnung zu den Kommunikationsinfrastrukturen mit Sendeanlagen

Art. 14 (Aufsicht)

(1) Stellt der Bürgermeister oder die Bürgermeisterin fest, dass Kommunikationsinfrastrukturen mit Sendeanlagen ohne Ermächtigung laut Artikel 10 oder ohne Meldung des Tätigkeitsbeginns laut Artikel 11 errichtet, installiert oder geändert wurden, ordnet er bzw. sie im Sinne von Artikel 7/bis Absatz 6 des Gesetzes mit begründeter Maßnahme den Abbruch der Infrastrukturen an und setzt dem Eigentümer und dem Betreiber dafür eine angemessene Frist von nicht weniger als 30 Tagen und nicht mehr als 90 Tagen. Verstreicht diese Frist erfolglos, geht die Gemeinde von Amts wegen laut Artikel 7/bis Absatz 6 des Gesetzes vor.

(2) Stellt der Bürgermeister oder die Bürgermeisterin fest, dass die Infrastruktur in Abweichung der Ermächtigung laut Artikel 10 oder der Meldung des Tätigkeitsbeginns laut Artikel 11 errichtet oder geändert wurde, da sie die genehmigten oder gemeldeten Maße überschreitet, ordnet er bzw. sie dem Betreiber an, die Infrastruktur der Ermächtigung oder der Meldung innerhalb von 60 Tagen anzupassen. Verstreicht diese Frist erfolglos, sorgt die Gemeinde gemäß Artikel 7/bis Absatz 6 des Gesetzes von Amts wegen für den Abbruch der nicht mit den genehmigten oder gemeldeten Maßen übereinstimmenden Teile.
