Verwaltungsgerichtsbarkeit - Schadenersatz -Verurteilung der Verwaltung zur Wiederherstellung des früheren Zustandes nur bei gebundenen AktenÖffentliche Arbeiten - Gerichtliche Aufhebung der Zuschlagserteilung - unzulässiger Ausschluß nach Abschluß des Werkvertrages

Die Verurteilung der Verwaltung zur Wiederherstellung des früheren Zustandes und demnach zu einem facere ist nur im Falle von gebundenen Akten statthaft, bei denen der Inhalt der Maßnahmen durch das Gesetz oder andere Normen unabrückbar vorgegeben ist und nicht auch bei Ermessensakten, deren Gestaltung vollständig oder auch nur teilweise der Verwaltung anheimgestellt ist.
 
Die vom Gemeinschaftsrecht den Mitgliedstaaten eingeräumte Möglichkeit, die im Fall, daß der Vertrag mit dem Zuschlagsempfänger bereits abgeschlossen wurde, die Aufhebungsklage gegen die Zuschlagserteilung auszuschließen und auf diese Weise den Rechtschutz der Bewerber von öffentlichen Aufträgen auf eine Schadenersatzforderung zu beschränken, scheint unvereinbar zu sein mit Art. 113 der Verfassung, wonach der Rechtschutz gegen die Akte der öffentlichen Verwaltung nicht ausgeschlossen oder auf besondere Anfechtungsmittel oder auf bestimmte Arten von Akten beschränkt werden darf.
