Zuweisung von Gewerbegrund - Bezahlung der Preisdifferenz bei Verstoss gegen das Veräußerungsverbot - Gerichtsbarkeit bei Anfechtung der entsprechenden Zahlungsaufforderung

Das Bestehen der Gerichtsbarkeit des Verwaltungsrichters hinsichtlich von Zahlungsaufforderungen ex Art. 35 des L.G. vom 20 August 1972, Nr. 15 mit der Begründung, dass diese in Ausübung einer hoheitlichen Prüfungsbefugnis hinsichtlich der Einhaltung der mit einer öffentlichen Förderung übernommenen Verpflichtungen seitens des Förderungsempfängers erfolgt ist und dass zudem die Zuweisung von Gewerbegrund die Nutzung des Territoriums laut Art. 7 des Reformgesetzes Nr. 205/2000 im weitesten Sinn betrifft, ist angesichts der neuren Rechtssprechung, insbesondere des Urteils Nr. 204 vom 6. Juli 2004 des Verfassungsgerichtshofes, das die Notwendigkeit der Einhaltung der Regelung gemäß Art. 103 der Verfassung bekräftigt, laut der subjektive Rechte grundsätzlich der Gerichtsbarkeit des ordentlichen Richters unterliegen und nur in den vom Gesetz bezeichneten Fällen in die Gerichtsbarkeit des Verwaltungsgerichtes fallen können, nicht mehr haltbar. Demzufolge fällt ein Rechtstreit bezüglich der Verhängung der vertraglich und gesetzlich vorgesehenen Sanktionen für den Fall der Nichteinhaltung der mit einer öffentlichen Förderung übernommenen Verpflichtungen seitens des Förderungsempfängers eindeutig in den Zuständigkeitsbereich des ordentlichen Richters, da er die Feststellung der Verletzung der vertraglich eingegangenen Verpflichtungen und somit ein subjektives Recht betrifft.
