Vergabe von öffentlichen Aufträgen - Befugnisse des Verwaltungsgerichts - Wiederherstellung des rechtmäßigen Zustandes - Folgen auf den bereits erfolgten, aber annullierten Vertragsabschluss

Die im Art. 7 des Gesetzes Nr. 205/2000 ausdrücklich vorgesehene Wiederherstellung des rechtmäßigen Zustandes kann nur dahin interpretiert werden, dass damit dem Verwaltungsrichter die Befugnis eingeräumt ist, dem Rekurssteller im Falle der Begründetheit der Klage auch ein konkretes Ergebnis zukommen zu lassen.
Dies bedeutet bei Wettbewerbsverfahren zur Vergabe öffentlicher Aufträge, dass unter Wiederherstellung nur die konkrete und effektive Auftragserteilung zu verstehen ist mit der Folge, dass der Verwaltungsrichter, aufgrund der ihm vom Gesetz Nr. 205/2000 zugestandenen ausschließlichen Gerichtsbarkeit – womit der Gesetzgeber für diese Verfahren die Konzentration des Prozesses vor einem einzigen Richter intendierte – mit der Urteilsfindung nicht nur die dem Vertrag vorausgehenden und für die Willensbildung der Verwaltung ausschlaggebenden Maßnahmen außer Kraft setzen bzw. annullieren kann, sondern auch, dass dadurch als Folge unweigerlich auch der damit betroffene Vertrag außer Kraft gesetzt wird.
