Jedes Bauvorhaben ist umweltrechtmäßig an seinem Vollendungszweck zu messen und nicht an den einzelnen Bauphasen, die zu seiner Erfüllung führen.
Dies auch deshalb, weil nach Gemeinschaftsrecht (erste Begründungserwägung der Richtlinie des Rates der Europäischen Gemeinschaften vom 27. Juni 1985 über die Umweltverträglichkeitsprüfung bei bestimmten öffentlichen und privaten Projekten 85/337) "bei allen technischen Planungs- und Entscheidungsprozessen die Auswirkungen auf die Umwelt so früh wie möglich berücksichtigt werden müssen".
Wenn man von einer möglichen Auslegung des Art. 4 II, Anhang II in Verbindung mit Art. 2 I der Richtlinie 85/337 in dem Sinne ausgeht, das zwar grundsätzlich eine Einzelprüfung der Projekte nicht erforderlich ist, sich jedoch die nationalstaatliche Bestimmung der "Arten von Projekten" sowie die Festlegung der "Kriterien und/oder Schwellenwerte" an die Aspekte, die in Art. 2 I der Richtlinie genannt sind (auch in Zusammenhang mit der sechsten und achten Begründungserwägung der Richtlinie) streng zu orientieren haben (insoweit also der Ermessensspielraum der Mitgliedstaaten eingeschränkt ist), entstehen Zweifel hinsichtlich der Frage – die deshalb dem Gerichtshof der Europäischen Gemeinschaften vorgelegt wird – ob es die Richtlinienregelung gestattet, daß die Umstrukturierung eines Flugplatzes bis unter 2.100 m Landebahn von vornherein, ausdrücklich oder implizite (Art. 2, Absatz 1 des L.G. Nr. 27/92 und Anlage II) oder durch eine für Flugplätze nicht anwendbare Regelung (Art. 2, Absatz 1 und 2) einer Umweltverträglichkeitsprüfung entzogen wird, obwohl eine erhebliche Umweltrelevanz vorliegt.
