Führerschein - Suspendierung und Widerruf aufgrund einer negativen amtsärztlichen Bescheinigung -richterliche Überprüfung wegen Begründungsmangel nicht ausgeschlossen

Gemäß Art. 129, Absätze 2 und 3 StVO gilt grundsätzlich, dass der Verwaltungsbehörde angesichts einer negativen amtsärztlichen Bescheinigung keinerlei Ermessensspielraum bezüglich der Verweigerung der beantragten Verlängerung der Fahrerlaubnis zusteht, mit der Folge, dass die Suspendierung bzw. der Widerruf des Führerscheines eine zwingende Rechtsfolge von Gesetzes wegen der vorausgesetzten rechtsmedizinischen Diagnose darstellt.
Daraus kann jedoch nicht in jedem Fall der Schluss gezogen werden, dass gegen den Bescheid des Führerscheinamtes, als einer rechtlich und inhaltlich strikt gebotenen Maßnahme, der Vorwurf der unzureichenden Begründung nicht greifen kann. Voraussetzung hierfür ist nämlich die Rechtmäßigkeit des dem Widerruf zugrunde liegenden ärztlichen Gutachtens. Ist dieses dem Widerruf zugrunde liegende ärztlichen Gutachten in sich selbst widersprüchlich oder unlogisch oder fußt dieses auf falschen Tatsachen, so können die Ergebnisse der fachärztlichen Untersuchungen einer richterlichen Überprüfung unterzogen werden.
