Bauleitplanerische Maßnahme - Eigentümer von nicht direkt betroffenen Grundstücken - Rechtsschutzinteresse in re ipsa - Genehmigungsverfahren des Bauleitplanes - geologisches Gutachten - nicht vor Beschlussfassung seitens des Gemeinderates nötig

Im Falle einer bauleitplanerischen Maßnahme besteht für den Eigentümer eines von dieser nicht direkt betroffenen Grundstückes nur dann ein Rechtsschutzinteresse, wenn aufgrund der Maßnahme sein Eigentum eine Beeinträchtigung erfährt.
Diese Beeinträchtigung ist im Prinzip nachzuweisen, doch kann sich dieselbe auch aus der Situation selbst, in re ipsa, ergeben ( in vorliegendem Falle wurde eine solche Beeinträchtigung für den Anrainer einer ausgewiesenen Gewerbezone von 15.000 m2, aufgrund der zu erwartenden Immissionen, als gegeben erachtet).
 
Das geologische Gutachten, von dem im Art. 1, Abs. 3 der Durchführungsverordnung ( D.L.H. vom 23. Februar 1998, Nr. 5) zum Landesraumordungsgesetz die Rede ist ("Studie der geologischen Eigenschaften des Bodens"), findet im Gesetz selbst (Art. 19) bei der Aufzählung der vor der Beschlussfassung zum Bauleitplan einzuholenden Gutachten keine Erwähnung. Andererseits setzt die Durchführungsverordnung keinen bestimmten Zeitpunkt für die Erstellung des Gutachtens fest, weshalb davon auszugehen ist, dass diese nicht unbedingt vor der Beschlussfassung der Gemeinde, jedoch innerhalb des komplexen Genehmigungsverfahrens zu erfolgen hat.
