Urbanistische Planung - Auffüllzone - Verbauung zu 70% - geschlossene Ortschaft - homogene Zone - Auffüllzone fernab von Siedlungseinheiten rechtswidrig

Gemäß Art. 36, Abs. 4 LROG Nr. 13 vom 11.August 1997 i.g.F., gelten Zonen, welche nach Inkrafttreten des Landesgesetzes vom 20. August 1972, Nr. 15 für den Wohnbau ausgewiesen werden, nicht als Erweiterungszonen, wenn die Baudichte zu 70 Prozent ausgeschöpft ist. Die Gesetzesnorm schränkt nicht ein, dass genannte Zonen im Bereich der geschlossenen Ortschaft oder in einer Wohnsiedlung sich befinden müssen, die der geschlossenen Ortschaft gleich zu stellen ist. Es muss sich aber um eine „homogene Zone  (eine in sich natürlich abgeschlossene Zone) handeln, welche auch objektiv (in urbanistischer Hinsicht) den Charakter einer Auffüllzone aufweist und nicht durch eine zweckbezogene Eingliederung von Grundstücken d.h durch urbanistisch unnatürliche Abgrenzungen geschaffen wird.
 
Die Ausweisung einer Auffüllzone fernab von anderen Siedlungseinheiten widerspricht den Grundregeln einer urbanistischen Planung, da es sich in einem solchen Falle wohl nicht um eine „Auffüllung  d.h. um eine natürlich vorgegebene zweckmäßige „Füllung  eines Baulandes mit bereits bestehenden Siedlungscharakter handelt. Zudem widerstrebt eine solche Ausweisung den Zielsetzungen des Landesentwicklungs- und Raumordnungsplanes, welcher vorsieht, dass „die Schaffung von Neubauflächen nach Möglichkeit in Anbindung an geeignete Siedlungseinheiten auszuweisen sind“.
